Abstract of Lecture

The name "Private International Law" (PIL), coined by an American writer (Joseph Story) has prevailed in much of the rest of the world, though not in the United States. The name "Conflict of Laws," first used by a Dutch writer (Ulrich Huber), has prevailed in the United States but not in Europe. Neither name is entirely accurate, but each of them reflects different assumptions about the nature, scope, and function of this subject. The lecture will examine these assumptions. It will explore, in particular, the extent to which PIL is indeed "Private" or "International" Law.
