The Martens Clause: Overview of Treaty Articles

The Martens Clause made its first appearance in international law in the Preamble to Convention (II) with Respect to the Laws and Customs of War on Land and its annex: Regulations concerning the Laws and Customs of War on Land in 1899. Hereafter, the Martens Clause has been incorporated several times in other treaties - in slightly different wording - but with the same meaning and scope.
